<p class="wp-block-paragraph"><strong>What can I say? </strong>The results weren&#8217;t terrible. But they weren&#8217;t particularly original, distinctive, or memorable either. Like so much AI-generated content, the designs stood out mainly for their algorithmic mediocrity.</p>

<p class="wp-block-paragraph">But how could it be any different? The neural networks behind generative AI tend to treat the average of the average as the safest and most correct solution. More advanced models may improve the results, but they will not solve this basic problem anytime soon.</p>

<p class="wp-block-paragraph" style="font-size:15px">Deep learning works by identifying patterns that appear repeatedly across large amounts of data. Patterns that occur very often are more likely to be treated as reliable or correct. As a result, generative AI naturally tends to produce solutions that are statistically common.</p>

<p class="wp-block-paragraph">Please do not get me wrong: <strong>Average is not necessarily bad.</strong> Nobody can be excellent at everything, so an average result may be perfectly acceptable or even genuinely useful for many people.</p>



<p class="wp-block-paragraph">Unless, of course, you hire a specialist. In that case, you might reasonably expect something above average. As a «professional» designer, I have never considered it my job to create merely average solutions. Sure, average might sometimes have been enough. But clients usually hire me to do something they cannot do themselves, not even with the help of AI.</p>



<p class="wp-block-paragraph">This is why I find it hard to get excited about what Claude currently produces as «design». For my work, it is simply not useful.</p>



<p class="wp-block-paragraph">Successful designers have always been those who did not simply offer what everyone else offered. They discovered what other people were not particularly good at and then became extremely good at exactly that.</p>



<p class="wp-block-paragraph">But back to the original point: For many people, an average solution is apparently good enough. And honestly, why not?</p>



<p class="wp-block-paragraph">Most people also live in an average apartment and lead a fairly average life. Mediocrity is everywhere, and AI is giving it another helpful little push. In all these cases, including design, AI is mainly a channel that processes the average opinions and average data of our world into new average opinions and average data. I<strong>t is, in other words, a mediocrity amplifier.</strong></p>



<p class="wp-block-paragraph">Design, on the other hand, lives through originality, contrast, personality, and sometimes uniqueness. So how can we train neural networks to consider not only the most common statistical patterns but also independent and innovative design ideas? How can we teach them creative judgment?</p>



<p class="wp-block-paragraph">I do not know. Perhaps we will figure it out one day. But I seriously wonder why we should bother.</p>



<p class="wp-block-paragraph">Even if AI occasionally produced something truly outstanding, most users probably would not notice. And they certainly would not appreciate it. Most people do not want something extraordinary. They want something familiar, predictable, and average. That is what they expect. And this is how mediocrity reproduces itself.</p>



<p class="wp-block-paragraph">The same is true for most websites. Perhaps 5 percent are genuinely bad and another 5 percent are excellent. The remaining 90 percent are simply average.</p>

<p class="wp-block-paragraph">Still, the AI industry wants us to believe that the right tools will allow us to achieve anything and turn every beginner into an expert.</p>



<p class="wp-block-paragraph">Every month brings another model, another framework, or another groundbreaking update that promises to increase our productivity once again. But the opposite is often happening.</p>



<h4 class="wp-block-heading">Optimization is starting to consume itself.</h4>



<p class="wp-block-paragraph">Anyone who tries to stay completely up to date at this speed will have very little time left to find genuinely good solutions. Many of us now spend more time testing new tools, learning how they work, watching video tutorials, and reading newsletters, posts, and articles than actually producing anything.</p>



<p class="wp-block-paragraph">For many self-proclaimed «AI experts» the working day already looks something like this: 50 percent maintenance, 30 percent administration, and the remaining 20 percent spent producing interchangeable, average solutions.</p>



<p class="wp-block-paragraph">Eventually, we may realize that we do not need the latest model or the best tool to create outstanding work. More often, we need the right mindset, a little passion and energy, and above all, time. But that’s precisely what’s now being systematically taken away from us.</p>

<p class="wp-block-paragraph">Starting on <strong>August 2, 2026</strong>, new transparency obligations will apply across the European Union for certain types of content, particularly images that have been generated or manipulated using artificial intelligence.</p>



<p class="wp-block-paragraph">At first glance, this sounds perfectly reasonable. After all, who wants to fall for deceptively realistic photos of stylishly furnished, spotless hotel rooms overlooking paradise – only to arrive at a run-down dump next to a major construction site? Or for apartment listings that leave you wondering, at the viewing, whether you’ve accidentally walked into the wrong building?</p>



<p class="wp-block-paragraph"><strong>But look closer, and things get complicated. Very complicated.</strong></p>



<p class="wp-block-paragraph">People were manipulating images long before generative AI existed. Throughout history, those who controlled images could shape public opinion – and, with it, hold power. Stalin famously had purged officials airbrushed out of photographs: the picture changed, and with it the past.</p>



<p class="wp-block-paragraph">Visual content occupies a special place in human perception. We trust images almost instinctively and rarely question their authenticity – far more than we trust written text. Or at least, that used to be the case. This is exactly why images have always been one of the most effective tools for deception and manipulation.</p>



<p class="wp-block-paragraph"><strong>What has changed is the scale.</strong></p>



<p class="wp-block-paragraph">With generative AI, deceptively realistic images – so-called <em>deepfakes</em> – can now be created within seconds, in massive quantities and without any specialized skills. The EU AI Act is the European Union&#8217;s response to this new reality.</p>

<p class="wp-block-paragraph">Unfortunately, these rules also leave many important questions unanswered. This article takes a closer look at these gray areas, contradictions and practical challenges, including questions such as:</p>



<ul class="wp-block-list narrow-list">
<li>What will still be allowed and what will not?</li>



<li>Where does image enhancement end and where does manipulation begin?</li>



<li>Why is the exact same visual result treated differently depending on whether it was created with Photoshop or with generative AI?</li>
</ul>



<h2 class="wp-block-heading">The legal framework</h2>



<p class="wp-block-paragraph">Article 50 of Regulation (EU) 2024/1689 is officially titled as <strong>«Transparency obligations for providers and deployers of certain AI systems»</strong><sup data-fn="2a6be064-c63c-4f06-8e78-e93d4dd8336f" class="fn"><a href="#2a6be064-c63c-4f06-8e78-e93d4dd8336f" id="2a6be064-c63c-4f06-8e78-e93d4dd8336f-link">2</a></sup></p>



<p class="wp-block-paragraph">Its purpose is to regulate the use of artificial intelligence within the European internal market while protecting safety, fundamental rights, democracy and the rule of law. </p>



<h2 class="wp-block-heading">Who does this regulation apply to?</h2>



<p class="wp-block-paragraph">One of the most common misunderstandings concerns exactly who these new rules apply to.</p>



<h3 class="wp-block-heading">Group 1: AI providers</h3>



<p class="wp-block-paragraph">Under the AI Act, a <em>provider</em> is generally a person or organization that develops – or has developed – an AI system and places it on the market under its own name or brand.</p>



<p class="wp-block-paragraph">Examples include:</p>



<ul class="wp-block-list narrow-list">
<li>Companies that develop generative image creation or editing software</li>



<li>Operators of platforms that generate images using artificial intelligence</li>
</ul>



<p class="wp-block-paragraph">According to Article 50(2), these providers must ensure that synthetic image, audio, video and text outputs are marked in a <strong>machine-readable format</strong> so they can be recognized as artificially generated or manipulated.</p>



<p class="wp-block-paragraph">This typically refers to technical solutions such as provenance information (a record of where an image came from), embedded metadata, or other robust detection mechanisms.</p>



<h3 class="wp-block-heading">Group 2: Professional users of AI</h3>



<p class="wp-block-paragraph">The AI Act calls this group «deployers» – a term that has caused considerable confusion. The German version of the law uses «Betreiber», which sounds like «operator of an AI service». It does <strong>not</strong> refer to companies operating AI services – that group has already been covered above.</p>



<p class="wp-block-paragraph">Instead, it refers to natural or legal persons who <strong>use</strong> an AI system. In other words, professional users or deployers of AI, such as:</p>



<ul class="wp-block-list narrow-list">
<li>Advertising agencies and media companies</li>



<li>Commercial content creators (film studios, marketing departments, etc.)</li>



<li>Professional designers and photographers</li>
</ul>



<p class="wp-block-paragraph">According to Article 50(4), they must disclose when published image, audio, or video content has been generated or manipulated using an AI system.</p>



<h2 class="wp-block-heading">Private use is exempt</h2>



<p class="wp-block-paragraph">These obligations do <strong>not</strong> apply to natural persons who publish AI-generated image, audio, or video content exclusively for personal and non-professional purposes.</p>



<p class="wp-block-paragraph">For example, a private travel blog would most likely fall under this exemption.</p>



<p class="wp-block-paragraph"><strong>Things become less clear, however, if the blog owner:</strong></p>



<ul class="wp-block-list narrow-list">
<li>uses affiliate links,</li>



<li>publishes sponsored content, or</li>



<li>displays advertising.</li>
</ul>



<p class="wp-block-paragraph">This is one of many gray areas within the AI Act. «Making money» is not necessarily the same as acting in a professional capacity, and the law does not clearly define where that line should be drawn.</p>



<h2 class="wp-block-heading">Disclosure requirements</h2>



<p class="wp-block-paragraph">Let&#8217;s now look at the actual obligation. Under the EU AI Act, both of the groups described above have a duty to disclose AI-generated or AI-manipulated image, video and audio content.</p>



<p class="wp-block-paragraph">Obvious exceptions include clearly fictional, artistic, or satirical content, as long as it does <strong>not</strong> claim to truthfully represent real events or real people.</p>



<p class="wp-block-paragraph">The first group, AI providers, must mark their content in a machine-readable format. The second group, users of AI systems, must label or identify the AI content they publish in a way that people can notice and understand right away, including those using assistive technology. They must also ensure that the machine-readable markings added by the AI generator are not removed, whether intentionally or accidentally.</p>



<p class="wp-block-paragraph">It can be assumed that publishers are responsible if published content does not meet these requirements. They therefore need to check how the content is actually delivered to users. Image editing processes or the content management system (CMS) used to publish an image can easily remove the AI provider’s machine-readable metadata without anyone noticing.</p>



<h2 class="wp-block-heading">Where does image enhancement end and manipulation begin?</h2>



<p class="wp-block-paragraph">The EU AI Act includes an exception for AI-based editing that only supports or improves an image and does not substantially alter its semantics.</p>



<p class="wp-block-paragraph">The key question is therefore: Does the editing only improve the quality of the image, or does it change what the image communicates?</p>



<p class="wp-block-paragraph"><strong>The following AI-based edits would most likely be considered enhancements and would not require disclosure:</strong></p>



<ul class="wp-block-list narrow-list">
<li>Adjusting brightness, contrast, or color</li>



<li>Reducing noise or sharpening the image</li>



<li>Removing dust or correcting lens defects such as distortion or vignetting</li>



<li>Resizing or adjusting the crop</li>
</ul>



<p class="wp-block-paragraph"><strong>The following AI-based edits change the meaning or content of an image and would require disclosure:</strong></p>



<ul class="wp-block-list narrow-list">
<li>Adding, moving, or removing people, clearly recognizable objects, or buildings within a landscape</li>



<li>Replacing the background</li>



<li>Removing damage from objects</li>



<li>Replacing clothing worn by a person</li>



<li>Changing facial expressions</li>
</ul>



<p class="wp-block-paragraph">Between these two groups lies a large area of unresolved gray zones.</p>



<p class="wp-block-paragraph"><strong>What happens when AI …</strong></p>



<ul class="wp-block-list narrow-list">
<li>opens eyes that were accidentally closed in a portrait?</li>



<li>makes someone look slightly younger?</li>



<li>makes a gray sky slightly bluer?</li>



<li>correctly reconstructs blurred text?</li>



<li>extends an image by one centimeter on one side?</li>



<li>removes unrecognizable, blurred people from the background?</li>
</ul>



<p class="wp-block-paragraph">We cannot answer these questions precisely, especially not in purely technical terms. There is no fixed number of changed pixels that tells us when the meaning of an image has been substantially altered.</p>



<p class="wp-block-paragraph"><strong>After all:</strong></p>



<ul class="wp-block-list narrow-list">
<li>removing a wedding ring,</li>



<li>changing a green traffic light to red, or</li>



<li>removing visible damage from a building</li>
</ul>



<p class="wp-block-paragraph">can seriously mislead viewers, depending on the context. By contrast, changing the color of a large part of an image may have almost no effect on its meaning.</p>



<p class="wp-block-paragraph">Future guidelines, and perhaps soon also courts, will need to clarify where a «substantial» change in meaning actually begins.</p>



<p class="wp-block-paragraph">And there is another question: In a dispute, how can anyone prove with certainty whether an image was generated by AI? Image generators have now become so advanced that even experts can no longer reliably distinguish AI-generated images from real photographs. Take a look at the following images, for example. Which of them are AI-generated? Can you say for sure?</p>

<p class="wp-block-paragraph">I consider this one of the regulation’s biggest practical weaknesses. Transparency requirements only work if it is possible to determine whether a piece of content falls under those requirements in the first place.</p>



<p class="wp-block-paragraph">In many future cases, however, this may be difficult or even impossible if no reliable records of the creation process remain. This issue is likely to become a recurring subject in legal disputes over the coming years.</p>



<h2 class="wp-block-heading">The deepfake</h2>



<p class="wp-block-paragraph">Article 3(60) of the EU AI Act defines a deepfake as an «AI-generated or manipulated image, audio or video content that resembles existing persons, objects, places, entities or events and would falsely appear to a person to be authentic or truthful.»</p>



<p class="wp-block-paragraph"><strong>This definition contains several conditions:</strong></p>



<ol class="wp-block-list narrow-list">
<li>The content was generated or manipulated using AI.</li>



<li>It resembles a real person, object, place, entity, or event.</li>



<li>It could falsely appear to be authentic or truthful.</li>
</ol>



<p class="wp-block-paragraph">That sounds clearer than it actually is, because none of these terms has a precise technical boundary. For example, what exactly does “resembles” mean? Does an image have to depict a specific person or place accurately, or is a general similarity enough?</p>



<p class="wp-block-paragraph">A synthetic image can be factually accurate even though it is not an authentic record of a real moment. Imagine, for example, that an AI system generates a photorealistic image of Zurich Main Station:</p>



<ul class="wp-block-list narrow-list">
<li>The architecture and visual appearance are accurate.</li>



<li>All visible signs are shown correctly.</li>



<li>Nothing fictional has been added.</li>
</ul>



<p class="wp-block-paragraph">Is this a deepfake? To answer this question, we need to distinguish between factual accuracy and documentary authenticity:</p>



<p class="wp-block-paragraph"><strong>Factual accuracy:</strong> The image accurately depicts what a place, person, or object looks like.<br><strong>Documentary authenticity:</strong> The image is a genuine record of a specific moment or event that actually occurred.</p>



<p class="wp-block-paragraph">For the website of the Swiss Federal Railways, this distinction may not matter. The AI generated images shows correctly the Zurich Main Station. </p>



<p class="wp-block-paragraph">For news reporting, legal evidence, or scientific documentation, however, the distinction is essential. The image does not document an actual moment. </p>



<p class="wp-block-paragraph">So a synthetic image can be a useful illustration, but it cannot and should not be used as proof that the situation shown actually took place.</p>



<p class="wp-block-paragraph">Therefore, the disclosure does not mean: <strong>This image is false.</strong> Instead, it means: <strong>This image is not a photographic documentation.</strong></p>



<p class="wp-block-paragraph">That&#8217;s because not every synthetic image of a real place or situation is intended to deceive. Therefore, it is questionable whether the negatively charged term &#8216;deepfake&#8217; is appropriate for a harmless and factually accurate visualisation.</p>



<p class="wp-block-paragraph"></p>



<h2 class="wp-block-heading">The accidental lookalike</h2>



<p class="wp-block-paragraph">Another unresolved question concerns entirely AI-generated people.</p>



<p class="wp-block-paragraph">Imagine that an AI system creates a person without using any real reference image. Since billions of people are alive today or have lived in the past, it is statistically likely that someone somewhere looks very similar to this generated person – perhaps even several people.</p>



<p class="wp-block-paragraph"><strong>Does that automatically turn the synthetic person into a deepfake?</strong></p>



<p class="wp-block-paragraph">An interpretation based only on resemblance to any random person would be impossible to apply in practice. No company could compare every AI-generated portrait with the entire world population.</p>



<p class="wp-block-paragraph">A generic synthetic model therefore cannot become a deepfake simply because a very similar-looking person happens to exist somewhere in the world.</p>



<p class="wp-block-paragraph">Other factors would need to be considered, such as:</p>



<ul class="wp-block-list narrow-list">
<li>Can the relevant audience recognize a specific, known person?</li>



<li>Is the person’s name, profession, or company mentioned?</li>



<li>Is a particular action or statement attributed to the person shown?</li>



<li>Was a reference image of a real person used to generate the image?</li>
</ul>



<h2 class="wp-block-heading">The Photoshop paradox</h2>



<p class="wp-block-paragraph">This is one of the biggest contradictions in the regulation.</p>



<p class="wp-block-paragraph">Let&#8217;s take a simple example: imagine that a relevant person has been removed from a photograph.</p>



<p class="wp-block-paragraph"><strong>Version A: </strong>The person was removed using generative AI.<br><strong>Version B: </strong>The person was removed in Photoshop by a human image editor.</p>



<p class="wp-block-paragraph">In both cases, the visible result is identical. Yet only the image from Version A must be disclosed as AI-generated or AI-manipulated – the image from Version B does not. Two identical images are treated differently simply because different tools were used.</p>



<p class="wp-block-paragraph"><strong>The same applies to:</strong></p>



<ul class="wp-block-list narrow-list">
<li>replacing a background with generative AI versus replacing it with traditional image editing</li>



<li>an AI-generated food image versus a food photograph staged with plastic, paint and glue</li>
</ul>



<p class="wp-block-paragraph">In all of these cases, viewers are deliberately misled. But only the AI-generated images must be disclosed.</p>



<p class="wp-block-paragraph">The EU gives the following reasons for this unequal treatment:</p>



<ul class="wp-block-list narrow-list">
<li>AI-generated manipulation requires less effort and little specialist knowledge</li>



<li>deceptive content can therefore be produced automatically and at large scale</li>
</ul>



<p class="wp-block-paragraph">These risks are real. Yet, the new EU rules do not explain why an AI visualization must be disclosed while an identical manual manipulation can remain unlabeled.</p>



<p class="wp-block-paragraph">A regulation focused on real-world impact should ask more often: Does this image mislead the audience about something that matters? And less often: Which technology was used to create the misleading result?</p>



<h2 class="wp-block-heading">The official EU icons</h2>



<p class="wp-block-paragraph"><strong>The EU also provides three optional icons:</strong></p>



<ul class="wp-block-list narrow-list">
<li>a neutral base symbol «AI»</li>



<li>Fully AI-generated</li>



<li>Partially AI-modified</li>
</ul>

<p class="wp-block-paragraph">Using these icons is voluntary. They are not official seals of approval and do not prove legal compliance. Anyone who uses them remains responsible for making sure that the disclosure is sufficient in the specific context.</p>



<p class="wp-block-paragraph"><strong>From a UX perspective, several questions remain:</strong></p>



<ul class="wp-block-list narrow-list">
<li>Will people understand these new symbols without accompanying text?</li>



<li>Will the icons still be recognizable on small thumbnails?</li>



<li>How small can the icons be displayed before they stop being useful?</li>
</ul>



<p class="wp-block-paragraph">Unfortunately, the EU guidance does not answer these questions in enough detail.</p>



<h2 class="wp-block-heading">Always visible, portable and accessible: an almost impossible combination</h2>



<p class="wp-block-paragraph">The EU AI Act and its accompanying guidance try to achieve several goals at the same time:</p>



<ul class="wp-block-list narrow-list">
<li>The label should be clearly visible when users first encounter the content.</li>



<li>It should appear directly alongside the content.</li>



<li>On digital devices, it should never be cut off or hidden by other elements in any responsive layout.</li>



<li>It should remain attached to the content when it is shared or downloaded.</li>



<li>It should be accessible to people with disabilities.</li>
</ul>



<p class="wp-block-paragraph">Each of these requirements makes sense on its own. Taken together, however, they are extremely difficult to achieve from a technical perspective, especially on the web.</p>



<h4 class="wp-block-heading">Solution 1: HTML/CSS labeling</h4>



<p class="wp-block-paragraph">A label or icon is displayed above or below the image.</p>

<h4 class="wp-block-heading">Solution 2: Embed the label directly into the image</h4>



<p class="wp-block-paragraph">The label is permanently burned into the image itself.</p>

<li>Works independently of websites, platforms, or media</li>

<li>Language-specific and cannot be translated automatically</li>

<h4 class="wp-block-heading">Solution 3: Metadata and Content Credentials</h4>



<p class="wp-block-paragraph">The information is stored inside the file in a machine-readable format.</p>



<p class="wp-block-paragraph"><strong>Pros</strong></p>



<ul class="wp-block-list narrow-list">
<li>Can be processed automatically</li>



<li>Remains with the file when it is shared or downloaded</li>
</ul>



<p class="wp-block-paragraph"><strong>Cons</strong></p>



<ul class="wp-block-list narrow-list">
<li>Not visible to people</li>



<li>Can accidentally be removed during export or file conversion</li>



<li>Cannot be read without appropriate software</li>
</ul>



<p class="wp-block-paragraph">None of these solutions satisfies all of the requirements. In practice, they will probably need to be combined.</p>



<p class="wp-block-paragraph">It will be interesting to see how the industry approaches this challenge. One thing is already becoming clear: AI disclosure is not just another step during image export. It is evolving into a multi-layered publishing workflow.</p>



<p class="wp-block-paragraph">For an international media company, that may be acceptable. For a small business, a nonprofit organization, or a single content manager, however, the required workflow seems disproportionately complex – almost absurd.</p>



<h2 class="wp-block-heading">Preserved after download – really?</h2>



<p class="wp-block-paragraph">Even if all of these requirements are met, we still cannot prevent third parties from:</p>



<ul class="wp-block-list narrow-list">
<li>cropping the image so that the embedded label disappears,</li>



<li>covering or removing the visible label,</li>



<li>taking a screenshot that removes all machine-readable information,</li>



<li>intentionally or unintentionally removing metadata during file conversion or compression.</li>
</ul>



<p class="wp-block-paragraph">For this reason, the EU&#8217;s goal of permanent labeling cannot realistically be achieved from a technical point of view.</p>



<p class="wp-block-paragraph">The most realistic objective is simply this: the disclosure should remain intact throughout the export, download and sharing processes that are under the publisher&#8217;s control.</p>



<p class="wp-block-paragraph"><strong>But what happens beyond that point?</strong></p>



<p class="wp-block-paragraph">Who is responsible if a perfectly reasonable image compression process removes all metadata? Or if a content management system automatically generates a thumbnail without the required label?</p>



<h2 class="wp-block-heading">Perhaps the most dangerous side effect</h2>



<p class="wp-block-paragraph">An AI disclosure system does more than simply provide information.</p>



<p class="wp-block-paragraph">It also creates a mental model. Over time, people may begin to assume that <strong>any image without a label must be authentic</strong>. That conclusion is both unintended and potentially dangerous.</p>



<p class="wp-block-paragraph"><strong>An unlabeled image may:</strong></p>



<ul class="wp-block-list narrow-list">
<li>have been manipulated using traditional, non-AI editing techniques,</li>



<li>not yet have been labeled or have been labeled incorrectly,</li>



<li>have been deliberately mislabeled,</li>



<li>have lost its label during downloading or cropping,</li>



<li>come from private, non-commercial use,</li>



<li>have been created outside the scope of the EU AI Act,</li>



<li>be considered artistic or fictional content that does not require disclosure.</li>
</ul>



<p class="wp-block-paragraph">From a consumer protection perspective, this creates a classic <strong>false sense of security</strong>.</p>



<p class="wp-block-paragraph">As a result, unlabeled images may appear more trustworthy than they actually are.</p>



<p class="wp-block-paragraph">In journalism and political communication, this could have serious consequences. A traditionally manipulated photograph might appear more credible simply because it does not carry an AI disclosure label.</p>



<p class="wp-block-paragraph">The AI Act is intended to build trust. Ironically, it may also create a new form of misplaced trust.</p>



<h2 class="wp-block-heading">What does the EU AI Act mean for countries outside the EU?</h2>



<p class="wp-block-paragraph">The EU AI Act applies within the European Union. In most countries outside the EU, there is currently no comparable legal requirement to disclose AI-generated or AI-manipulated images. And simply making a website technically accessible from within the EU is not enough for the AI Act to apply.</p>



<p class="wp-block-paragraph">However, being based outside the EU does not automatically put a company beyond the reach of these rules. The AI Act is generally relevant for non-EU companies if at least one of the following conditions applies:</p>



<ul class="wp-block-list narrow-list">
<li>their content is directed at customers or potential customers in the EU,</li>



<li>they offer products or services within the EU,</li>



<li>their website or service is operated from servers located in the EU.</li>
</ul>



<p class="wp-block-paragraph">At the same time, many countries are working on their own AI regulations. Switzerland, for example, has decided to implement the Council of Europe&#8217;s AI Convention: a consultation draft is expected by the end of 2026 and is likely to address issues such as transparency, data protection, non-discrimination and regulatory oversight. Companies outside the EU should therefore also keep an eye on upcoming rules in their own country.</p>



<h2 class="wp-block-heading">Legal risks for companies that fail to comply</h2>



<h5 class="wp-block-heading has-custom-css wp-custom-css-653ac5b4">Regulatory fines</h5>



<p class="wp-block-paragraph">Within the European Union, violations of the AI Act can be enforced by the competent authorities through administrative fines.</p>



<p class="wp-block-paragraph">For companies outside the EU without offices or legal entities inside the EU, enforcing such fines across borders is likely to be difficult and often not worth the administrative effort. Being located outside the EU does not provide complete legal protection – but in practice, it seems highly unlikely that a company without any EU presence would actually receive an administrative fine from an EU authority.</p>



<h5 class="wp-block-heading has-custom-css wp-custom-css-860f175e">Injunctions and corrective measures</h5>



<p class="wp-block-paragraph">Competitors or organizations that are legally entitled to sue may seek to stop the continued use of non-compliant content.</p>



<p class="wp-block-paragraph">In most cases, companies would first be given an opportunity to correct the issue. Yet, they would still be responsible for the legal costs associated with the complaint.</p>



<p class="wp-block-paragraph">In some situations, having to stop a marketing campaign or replace published content at short notice may be far more expensive than the fine itself.</p>



<p class="wp-block-paragraph">Note that even without an EU presence, European competitors may still be able to pursue civil claims before courts in a company&#8217;s home country.</p>



<h5 class="wp-block-heading has-custom-css wp-custom-css-65eb3183">Claims for damages</h5>



<p class="wp-block-paragraph">Claims for damages are generally possible, but they normally require proof of actual financial harm, causation and the other legal requirements for liability. A mere competitive advantage gained through non-compliance is usually not enough on its own.</p>



<h2 class="wp-block-heading">Copyright implications</h2>



<p class="wp-block-paragraph">The new disclosure requirements do not change copyright law.</p>



<p class="wp-block-paragraph">The current legal situation for AI-generated content can be summarized as follows:</p>



<ul class="wp-block-list">
<li>Content created largely autonomously by AI – whether text, audio, video, or images such as a logo – generally does not receive copyright protection. A person who asks an AI system to create content through a prompt does not automatically become the author of the result. In principle, this means that purely AI-generated content may be copied and republished by others.</li>



<li>If AI is used as a tool within a substantial human creative process, however, the final result may be protected by copyright. The boundary is unclear and difficult to define. At what point does the final expression contain enough individual human creative decisions? Who can assess this reliably? Legal disputes will likely require human experts to evaluate these highly interpretive cases.</li>
</ul>



<p class="wp-block-paragraph">The main lesson is that we should be cautious before assuming that AI-generated content is free to use. Such content may still be protected by copyright if it has later been integrated into an independent human creative process. It would therefore be risky to assume that an image carrying an AI disclosure label can automatically be used without permission.</p>



<h2 class="wp-block-heading">A practical guide</h2>



<p class="wp-block-paragraph">Until the EU – and possibly the courts – provides clearer answers to the open questions, companies should act carefully and use a transparent decision-making process.</p>



<p class="wp-block-paragraph">The following six questions should be considered for every image before publication. Only if all six questions are answered with «yes» would disclosure be required:</p>



<ol class="wp-block-list">
<li>Was an AI system used at all?</li>



<li>If an existing photograph was edited using AI, did the AI alter recognizable content or add, remove, move, or substantially change any elements?</li>



<li>Could viewers understand the image as a photograph because it refers to the real world?</li>



<li>Does the image make an implicit claim to truthfulness? This should generally be assumed for portraits of real people and product images.</li>



<li>Is the image being published in a commercial or professional context?</li>



<li>Is the content – or the medium in which it is published – also directed at audiences in the EU?</li>
</ol>



<h2 class="wp-block-heading">My conclusion</h2>



<p class="wp-block-paragraph">The EU AI Act responds to a real problem: AI-generated images can no longer be reliably distinguished from photographs. Highly realistic image manipulation can now be created by almost anyone and distributed with very little effort. In journalism, legal contexts, education and science, transparency about the origin of visual content is clearly useful and can provide real value.</p>



<p class="wp-block-paragraph"><strong>But the current approach in the EU AI Act remains unsatisfactory. </strong></p>



<p class="wp-block-paragraph">The technical implementation of image disclosure on the web has not been properly considered. A label embedded directly in an image remains attached when the file is downloaded, but it is not accessible. An HTML label can be accessible, but it becomes separated from the image when the file is shared.</p>



<p class="wp-block-paragraph">Small companies, in particular, face the disproportionate challenge of having to manage legal requirements, UX, accessibility, image production and complex technical processes at the same time.</p>



<p class="wp-block-paragraph">I am especially concerned about the possible side effect of the entire labeling system. Once people expect AI-generated images to carry a label, the absence of a label may be wrongly interpreted as proof that an image is authentic.</p>



<p class="wp-block-paragraph">The EU AI Act may therefore create new legal uncertainty, major implementation challenges and possibly a dangerous false sense of security.</p>



<h4 class="wp-block-heading">The rules have several major weaknesses:</h4>



<ol class="wp-block-list">
<li>They do not clearly distinguish between content-related and technological aspects</li>



<li>They treat manipulation and deception differently depending on the technology used.</li>



<li>Key terms such as «resembles», «authentic», «truthful» or «significant change in semantics» are ambiguous and lead to significant gray areas.</li>



<li>The new AI labels, at best, tell us something about the method used to create the image, but not whether the image is true.</li>
</ol>



<h4 class="wp-block-heading">What should be regulated more clearly?</h4>



<p class="wp-block-paragraph"><strong>Useful improvements would include:</strong></p>



<ul class="wp-block-list narrow-list">
<li>reliable criteria for permitted and prohibited uses,</li>



<li>binding technical standards,</li>



<li>accessible reference implementations,</li>



<li>and, where appropriate, simplified requirements for smaller companies.</li>
</ul>



<p class="wp-block-paragraph"></p>



<p class="wp-block-paragraph">Above all, the EU AI Act is a response to a technology that society mainly perceives as a threat. Regulation tends to emerge where uncertainty, loss of control and public pressure come together.</p>



<p class="wp-block-paragraph">That is precisely why such regulation should be clear, precise and easy to implement.</p>

		<title>The Three Layers of Accessibility</title>

					<description><![CDATA[Why Inclusive Interfaces Should Not Be the Same for Every User]]></description>

			<h5>Many designers experience accessibility as a form of creative restriction.</h5>
<p>They want to create digital products that are accessible to as many people as possible and can be used reliably by people with disabilities. At the same time, they often feel that meeting accessibility requirements makes their solutions more similar, less expressive, and less distinctive. They perceive accessibility requirements as a very tight straitjacket that leaves little room for creative freedom.</p>
<p>When numerous technical, visual, and perceptual requirements must be met, it seems almost impossible to deviate from established patterns.</p>
<h5>This criticism is not entirely unfounded. It raises a number of important questions:</h5>
<ul>
<li><strong>Is meeting accessibility standards enough for good inclusive design?</strong></li>
<li><strong>Is compliance with these standards the only quality criterion in accessible design?</strong></li>
<li><strong>If not, where is the space for originality, emotion, visual metaphor, ambiguity, or a deliberate break with established conventions?</strong></li>
</ul>
<p>Good design thrives on differentiation, visual metaphors, associative relationships, and sometimes even on ambiguity, surprise, or a deliberate break with established conventions.</p>
<p>These questions are the starting point for the following reflections.</p>
<p>&nbsp;</p>
<h3>A familiar tension: Novice Support vs. Expert Efficiency</h3>
<p>We encounter similar issues outside the realm of inclusive design as well—many software applications must cater to very different user groups: Beginners need guidance, explanations, help texts, elements that are as intuitive and consistent with their expectations as possible, and reduced complexity. Experienced users, on the other hand, want direct access, keyboard shortcuts, powerful functions, as little redundancy as possible, and no unnecessary assistance.</p>
<p>What supports some users can get in the way of others. What gives some users confidence can feel slow, restrictive, or unnecessarily cumbersome to others.</p>
<p>This tension can be described as a conflict between overwhelming beginners and slowing down experts. A user interface that is too complex overwhelms inexperienced users. An interface that is too heavily geared toward inexperienced users reduces their efficiency.</p>
<p>&nbsp;</p>
<h2>Below is an overview of typical areas of tension in interface design</h2>

<p>Modern UX design addresses this with concepts such as progressive disclosure, layered or adaptive interfaces — see the list at the end of this post.</p>
<p>Features, help options, and complexity are not presented to everyone in the same way, but are made available gradually, contextually, or optionally. Beginners receive support. Advanced users can hide this support, skip it, or replace it with workflows that suit them.</p>
<p><strong>These are precisely the principles we need in accessibility as well.</strong></p>
<p>&nbsp;</p>
<h2>Three Types of Accessibility Measures</h2>
<p>Not all accessibility measures have the same effect. That is why it is helpful to categorize them into three groups.</p>
<h3>1. Universal Baseline Measures</h3>
<p>The first group includes measures that benefit nearly everyone and do not significantly disadvantage anyone. These include a clear structure, consistent navigation, easily recognizable interactive elements, meaningful labels, sufficient contrast, good readability, logical information architecture, and understandable feedback.</p>
<p>These measures improve not only accessibility but also overall usability. They are not a special solution for people with disabilities, but rather an expression of professional interface quality.</p>
<h3>2. Invisible or Non-Disruptive Assistive Measures</h3>
<p>The second group comprises measures that significantly help certain people but are barely noticeable to others. These include semantically correct HTML, keyboard accessibility, clean focus handling, screen reader-compatible labels, correctly marked error messages, or technical compatibility with assistive technologies.</p>
<p>A user who works with a mouse and screen barely notices these measures. For a person navigating with a screen reader or keyboard, however, they can be crucial. These measures should therefore be standard practice. They do not interfere with others, but they can substantially improve accessibility.</p>
<h3>3. Preference-Based Support Measures</h3>
<p>The third group is the most challenging. It includes measures that are very helpful for some people but may be disruptive, restrictive, or inefficient for others.</p>
<p>These include, for example: Easy Language, very large font sizes, high-contrast mode, reduced animations, highly simplified user interfaces, detailed help texts, icon support, read-aloud functions, or alternative forms of navigation.</p>
<p>These measures are important. However, they should not automatically replace the standard presentation. A version in Easy Language can be an enormous help for people with cognitive disabilities, lower literacy, or limited language proficiency. For others, however, the same simplification may reduce precision, nuance, or usefulness — especially in legal, medical, scientific, or technical contexts.</p>
<p>Technical terms, metaphors, linguistic nuance, and complex arguments are not inherently barriers. In certain contexts, they are necessary.</p>
<p>This is particularly true for legal, medical, scientific, or technical content. In these areas, language often needs to maintain a high degree of precision. If it is oversimplified, it can lose accuracy.</p>

<h2>Accessibility needs standards. Inclusion needs adaptability</h2>
<p>This is also why a website that conforms to the Web Content Accessibility Guidelines is not automatically a truly inclusive website. WCAG is strongest at the first two layers of this model: universal baseline measures and invisible or non-disruptive assistive measures. These are areas where accessibility can often be translated into relatively objective, testable criteria: contrast ratios, keyboard accessibility, visible focus, semantic structure, labels, error identification, or compatibility with assistive technologies.</p>
<p>The third layer is more complex. It includes measures whose usefulness depends heavily on the audience, context, task, prior knowledge, cognitive load, and personal preference. WCAG has included understandability as one of its core principles since version 2.0. However, understandability cannot be measured in the same way as a contrast ratio or keyboard operability.</p>
<p>For whom is a text understandable? In which situation? With what level of prior knowledge? For which task?</p>
<p>A legally precise contract, a medical report, a scientific analysis, or technical documentation cannot be simplified without limits. At some point, simplification may improve access for some users while reducing precision, nuance, or usefulness for others. Conversely, the same linguistic complexity can be a substantial barrier for people with lower literacy, cognitive disabilities, limited language proficiency, or little domain knowledge.</p>
<p>This is where accessibility can no longer be solved by universal minimum standards alone. It requires alternative representations, adaptive interfaces, user preferences, and context-sensitive support.</p>
<p>&nbsp;</p>
<h2>Accessibility Requires Self-Determination in Both Directions</h2>
<p>Accessibility is often viewed as a moral obligation — and it is. A society that takes digital inclusion seriously must give special consideration to people with disabilities. But this does not automatically mean that everyone must use the same simplified or adapted interface.</p>
<p>People with disabilities should be given the opportunity to use content and interfaces in the way they need: with higher contrast, reduced motion, easier-to-understand language, larger font, alternative input methods, or additional guidance.</p>
<p>At the same time, people who do not need this support should not be unnecessarily slowed down, underchallenged, or restricted in their ability to absorb information.</p>
<p>This is neither discrimination nor segregation, as long as the alternative modes are designed to be equivalent, respectful, and non-stigmatizing. On the contrary: it is an expression of respect not to confine people to a single form of use.</p>
<p>&nbsp;</p>
<h3>From «One Size Fits All» to Adaptive Accessibility</h3>
<p>Digital design has a major advantage over analog media: interfaces do not have to be static. They can adapt.</p>
<p><strong>A good accessible product should therefore consist of several layers:</strong></p>
<ol>
<li>a robust, accessible foundation that applies to everyone</li>
<li>technical layers that are as invisible as possible and reliably support assistive technologies</li>
<li>individual customization options, alternative visual representations that appeal to different senses and usage patterns, and adaptive modes that account for different user needs</li>
</ol>
<ul><strong>These could include:</strong></p>
<ul class="narrow-list">
<li>an Easy Language mode</li>
<li>an expert mode</li>
<li>a reduced (reading) mode</li>
<li>a high-contrast theme</li>
<li>adjustable font sizes</li>
<li>the option to reduce motion or disable autoplaying media</li>
<li>the ability to adjust the density of information</li>
<li>the ability to turn icon-based navigation on or off</li>
<li>displaying explanatory help or context-sensitive support</li>
<li>the ability to use keyboard shortcuts</li>
</ul>
</ul>
<p>&nbsp;</p>
<h2>Conclusion</h2>
<p>Inclusive design and creative freedom do not have to be mutually exclusive. Conflict arises primarily when accessible solutions are implemented as rigid “one-size-fits-all” approaches.</p>
<p><strong>The challenge, therefore, is not:</strong> How do we design an interface that is as accessible as possible and works in exactly the same way for all users? <strong>Rather:</strong> Where do people need choices because their needs differ?</p>
<p>Accessibility should therefore not be seen as a limitation, but as a basic requirement: a stable, inclusive foundation for everyone, supplemented by adaptive and customizable layers for different abilities, preferences, and usage contexts.</p>
<p><strong>Not everyone needs the same interface. But everyone deserves an interface that meets their needs.</strong></p>

<h2>Concepts for implementing an adaptable, inclusive design</h2>
<h3>Progressive Disclosure</h3>
<p>Complexity is revealed step by step. The primary interface shows only the essentials; advanced features remain accessible but do not dominate. This concept is particularly relevant for addressing the conflict between novice and expert usage.</p>
<h3>Progressive Enhancement</h3>
<p>The core experience is robust and accessible; additional visual, interactive, or performance-enhancing layers are added on top without compromising the basic functionality.</p>
<h3>Universal Design</h3>
<p>The classic universal design principles already incorporate the principle of accommodating different preferences and abilities. Particularly relevant are «Equitable Use», «Flexibility in Use» and «Simple and Intuitive Use». Universal Design demonstrates that adaptable systems function better than segregated specialized solutions.</p>
<h3>User Preference Media Features</h3>
<p>Modern CSS/browser mechanisms such as prefers-reduced-motion, prefers-contrast, prefers-color-scheme, forced-colors, or prefers-reduced-transparency allow for respecting users’ operating system preferences. «Media Queries Level 5» documents these user preference features.</p>
<h3>WAI-Adapt / Personalization Semantics</h3>
<p>W3C is working on approaches that allow content, icons, help text, links, buttons, and keyboard shortcuts to be semantically marked up in such a way that user agents or extensions can adapt them to individual preferences.</p>

					<description><![CDATA[About the subjectivity of our perception and its impact on the User Experience]]></description>
										<content:encoded><![CDATA[<p><strong>A User Experience &#8211; actually every experience we have &#8211; is a construct of our mind, our cognition. It has more to do with our inner than with the outer world or what we commonly call «reality».</strong></p>
<p>This may sound rather unusual to some people. But that is only because many of us rarely think about the processes of perception and processing that are constantly going on inside of us. Very few people think about what happens in our brains when we meet a new person, read something, or use a website.</p>
<p>&nbsp;</p>
<h2>The Constructed Reality</h2>
<p>First, we should be aware that not all of the information that our senses receive is processed. It is estimated that we receive about 11 million bits of information per second through our senses, but we can only process about 40 bits of information per second*<sup>1</sup>. So a lot of information is initially &#8220;filtered out&#8221;. Our brain makes this selection very quickly, without our awareness &#8211; this is called «preattentive processing».</p>
<p>The remaining pieces of information that are selected for further processing are also not &#8220;consciously&#8221; available to us. They are first heavily adapted before they are transported into our consciousness, enriched with prior knowledge and hypothetical assumptions.</p>
<p><strong>What we think we perceive objectively is the product of highly complex processing operations of our brain.</strong></p>
<p>Similar to how an application like ChatGPT presents us with a pretty simple user interface while highly complex processes are running in the background, human consciousness provides us with a «user-centered» reality that represents only a tiny fraction of the information that surrounds us and is only a small reflection of what our brain actually processes and stores.</p>
<p>In addition, our cognitive processing has some peculiarities due to the way our brains are structured. This is partly because our brains have to be extremely flexible, because apparently no one knew exactly what skills humans would eventually need. Our ability to read is a good example of this – it is a very recent invention in evolutionary history. However, our brain is so flexible that it can not only learn to read, but also to do other, completely unfamiliar things. It can even restructure itself to perform repetitive tasks faster, more efficiently, and most importantly, more intuitively. This amazing ability is called «Neuroplasticity».</p>
<p>For example, in the case of blind people, areas of the brain that are actually responsible for processing visual stimuli are freed up and used for other abilities. Thus, blind people have a more sensitive sense of touch and hearing than seeing people. They can also process spoken language much more quickly. Anyone who has seen a blind person use a screen reader knows what I am talking about.</p>
<p>&nbsp;</p>
<h2>Selective perception and cognitive biases</h2>
<p>Due to our limited processing capacity in the face of information overload, our brains are forced to perform many processes as simply and efficiently as possible. It prefers familiar solutions, simplifies complex structures and facts, and likes to take shortcuts when solving problems*<sup>2</sup>. This leads, however, to difficulties in certain situations. In many cases, so-called biases occur, i.e. deviations between the objectively expected result and the result of our subjective processing.</p>
<p>Some of these biases are so pervasive that our normative expectations have adapted to these misinterpretations. There are hundreds of examples of this in perceptual and cognitive science that have been demonstrated in numerous studies.</p>
<p>I would like to give just two examples here. For those who are interested in this topic, I have an interesting link at the end of this post.</p>
<p>&nbsp;</p>
<h3>1. Optical Center</h3>
<p>The «Optical Center effect» describes a bias in the way we judge objects. When asked to determine the exact vertical center of an object, almost all of us tend to define it about two to three percent higher than it actually is geometrically or mathematically. We have become so accustomed to this bias that positioning slightly above the geometric center seems more harmonious and natural to us than the exact geometric center, and we prefer it.</p>

<p>Sometimes unconsciously, but also consciously, we use the optical center in design or interior decoration. For example, pictures in a frame or text on a book page are usually vertically positioned higher than their geometric center. The center lines of our letters are all at the optical center. If they were in the geometric center, they would feel &#8220;out of place&#8221; &#8211; in other words, they would appear disharmonic to us.</p>

<p>The causes of this bias are not fully explored scientifically. It is probably a combination of our brain&#8217;s drive for efficiency and early childhood conditioning.</p>
<h4>Striving for Efficiency</h4>
<p>As mentioned above, our brain&#8217;s striving for efficiency is mainly based on the limitation of our cognitive abilities. For this reason, the optimal solution to many problems is too time-consuming and resource-intensive. To solve these problems, our cognition falls back on simplifying decision strategies (so-called heuristics) or already existing solutions and results in order to arrive as quickly as possible at a good, but not necessarily exact or optimal solution. This is also the case when judging the center of an object.</p>
<h4>Conditioning</h4>
<p>Conditioning is based on the fact that, from an early age, our brains have a lot to do with interpreting meta-information conveyed to us through facial expressions. In our interpersonal communication, it is extremely important to recognize the mood of the person with whom we are interacting on an ad hoc basis. Facial expressions occur almost exclusively in the lower part of the face &#8211; that is, we focus on the mouth, nose, and eyes &#8211; while the upper part of the head (forehead, hair) is perceived only peripherally. It is filtered out and tends to receive less attention. This leads to an overemphasis and overvaluation of the lower half of the face.</p>

<p>The overemphasis or exaggeration of the lower part of the face is so ubiquitous that when you ask people (who are not professional illustrators, artists or photographers) to draw a face, they usually place the eyes much too high*<sup>3</sup>. Anatomically correct, the eyes are almost exactly in the middle of the head.</p>

<p>As already mentioned, interpreting faces is so important to us that the principle of exaggerating the lower half of the face is also transferred to other areas on a quasi-universal basis. The technical term for this is «Selective Availability». It describes the fact that our brain makes certain results, concepts and approaches that we have frequently and successfully applied more readily available. As an implication, these patterns or information are applied more oftenin our cognitive processes than we sometimes like – even in tasks or problem solving that have absolutely nothing to do with the original task. This is also the direction of our second example:</p>
<p>&nbsp;</p>
<h3>2. Anchoring effect</h3>
<p>The «Anchoring effect» describes the tendency of people to be strongly influenced in their judgments or decisions by the context or by a piece of information that is immediately available &#8211; the so-called anchor &#8211; even if this anchor has nothing to do with the actual question.</p>
<p>In a study by Tversky and Kahneman*<sup>4</sup>, subjects were asked to spin a wheel of fortune. The wheel gave them a number between 0 and 100. The subjects were then asked to estimate what percentage of the members of the United Nations were African countries. The results were astonishing because the anchors obtained from spinning the wheel significantly influenced the estimates. The average of all estimates was 45%. However, the mean of the estimates of people who had previously spun a number of 10 or less on the wheel of chance was only 25%.</p>

<p><strong>How does this bias arise?</strong></p>
<p>The so-called anchoring task (spinning the wheel of chance and getting a random number) activates memory content that matches the anchor number and makes it available in easily retrievable areas of our memory for subsequent tasks. The information in these areas is then used preferentially, even in tasks that have nothing to do with the original task.</p>

<h2>Practical Significance</h2>
<p>What we experience and believe we know is a product of our cognition and, unfortunately, of deliberately employed deception.</p>
<p>The mere fact that we are informed more frequently or more emotionally about certain issues or claims through the ubiquitous media means that we weight and evaluate them differently than issues about which we are rarely informed. This can lead us to grossly overestimate certain risks simply because the media reports on them more frequently.</p>
<p>For example, the vast majority of people rate the risk of being attacked by a shark as significantly higher than the risk of being killed by a falling coconut*<sup>5</sup>. However, the probability is exactly the opposite. But we tend to be more aware of shark accidents, and shark attacks are probably more frequently reported in the media than beachgoers killed by falling coconuts.</p>
<p>Anchors can also play a critical role in negotiation situations. For example, the subjective perception of loss or gain depends heavily on the initial offer, which can significantly influence the negotiation process. Sellers and online shops like to offer products at a high price and then reduce the price significantly, giving the impression that the price is now extremely low.</p>
<p>Even experts are not completely immune to the anchoring effect. Studies*<sup>6</sup> show that judges, experts and juries have been massively manipulated by it in the past. In this context, there are other methods that are sometimes consciously or unconsciously used to influence us in one direction or another, such as</p>

<li><a href="https://cognitive-ux.com/name_en/default-effect/" target="_blank" rel="noopener">Default Effect</a></li>
<li><a href="https://cognitive-ux.com/name_en/halo-effect/" target="_blank" rel="noopener">Halo Effect</a></li>
</ul>
<p>These principles do not necessarily have to be used to our disadvantage. When applied correctly, they can even make a decisive contribution to high usability and exceptional User Experience.</p>
<p>A UX/UI designer who knows that our short-term memory is limited or that they can overwhelm a user if they provide them with too many options (see <a href="https://cognitive-ux.com/name_en/hicks-law/" target="_blank" rel="noopener">Hick&#8217;s Law</a>) can significantly improve usability, if not the entire user experience, through the application of cognitive principles. It is therefore very important to know the cognitive principles necessary for this.</p>
<p>That&#8217;s why I&#8217;ve spent the last few months putting together the most comprehensive overview possible of the cognitive principles that play a major role in a good user experience, and I&#8217;m pleased to present it here:</p>

<p class="has-medium-font-size wp-block-paragraph"><mark style="background-color:rgba(0, 0, 0, 0);color:#ff6868" class="has-inline-color">A grid system is a framework used in design to arrange elements in a structured and consistent way. </mark></p>



<p class="wp-block-paragraph">It consists of a series of horizontal and/or vertical lines that divide the page into sections and help designers place elements such as text, images and graphics in a way that improves clarity and aesthetic appeal. The number and width of columns and spaces often follow fixed structural guidelines or a design system. Aspects of perceptual psychology in particular play a decisive role here.</p>



<p class="wp-block-paragraph">The consideration of factors such as the visual <strong>perception process</strong>*<sup>1</sup>, <strong>Miller&#8217;s numbe</strong>r*<sup>2</sup> and relevant <strong>design laws</strong>*<sup>3</sup> – such as the law of proximity or the law of the common region – supports the perception process and forms the basis for easy accessibility.</p>



<p class="wp-block-paragraph">A perceptual-psychological approach to grid design is very important, as a grid represents the invisible basic structure of the design and &#8211; even if it is later no longer visible to the user &#8211; is responsible for the compositional harmony and consistency of the entire design. </p>



<p class="wp-block-paragraph">In addition, a consistently applied grid system can be a distinctive design element in itself, making the overall design recognisable, unique and aesthetically pleasing.</p>

<h2 class="wp-block-heading">Grid vs. Layout Grid</h2>



<p class="wp-block-paragraph">A «<strong>Grid System</strong>» basically consists of a «<strong>Grid</strong>» and a «<strong>Layout Grid</strong>». The «<strong>Grid</strong>» consists of a certain number of units of equal size and forms the underlying grid system (marked <strong>red</strong> in the following illustration). The combination of these smallest cells creates a superordinate «<strong>Layout Grid</strong>» (marked in <strong>blue</strong>), to which the page elements in the design are aligned.</p>

<p class="wp-block-paragraph">Typically, there is only one cross-page «grid» for a design, but there may be different «layout grids» for different page types, such as one for the home page, one for the overview pages, and another for the detail pages.</p>

<p>Grids have their origins in 15th century book printing and were later integrated into the design process by designers such as Jan Tschichold, Josef Müller-Brockmann and the <a href="https://swissgrid.posterhouse.org/" target="_blank" rel="nofollow noopener"><strong>Swiss School</strong></a>*<sup>4</sup>.</p>

<h2 class="wp-block-heading">What types of grids are there?</h2>



<p class="wp-block-paragraph">In addition to horizontally and vertically structured grids, there are also so-called «Modular Grids», which divide an area into units both horizontally and vertically. These grid systems are particularly versatile and are suitable for more complex layouts.</p>

<p class="wp-block-paragraph">In the western world, where people write horizontally, grids that divide a surface into vertical sections are of little use in responsive web design because the height of the text columns cannot be predicted due to the responsive nature of the design.</p>



<p class="wp-block-paragraph">Vertical dimensions can only be reliably planned for in web design if sufficient free space or buffer zones are taken into account. This makes a consistent vertical structure in a responsive context much more difficult and often impractical in practice.</p>

<h2 class="wp-block-heading">Responsive Grid Systems</h2>



<p class="wp-block-paragraph">In the print sector, grid systems have long formed the basis of most designs. However, grids also play an important role in the design of interactive user interfaces.</p>



<p class="wp-block-paragraph">While compositional aspects and readability requirements are the main focus in the print sector, the need to develop «responsive grids» is a central challenge in web design. Responsiveness in this context means that the design adapts optimally to the size of the output medium.</p>



<p class="wp-block-paragraph">Responsive grids must therefore not only have fixed dimensions, but must at least partially use flexible units. There are two basic ways of doing this:</p>



<ol class="wp-block-list">
<li>Make adjustments to the grid dimensions via so-called «Media Queries»*<sup>5</sup> <strong>(adaptive approach)</strong></li>



<li>Use percentage values for the grid dimensions <strong>(fluid approach)</strong></li>
</ol>



<h4 class="wp-block-heading"><strong>Adaptive vs. fluid approach</strong></h4>



<p class="wp-block-paragraph">Below are two different grids that I created with the «<a href="https://thomas-sokolowski.com/grid-generator.html" target="_blank" rel="noreferrer noopener">Ultimate Grid Generator</a>». At the top, an <strong>adaptive</strong> grid system that is controlled by a series of media queries such as @media (max-width: 768px) { … }; and below, a completely <strong>fluid</strong> grid that works without media queries, using only percentage calculations for responsive adjustments. Try resizing both of them with the handlebars (bottom right) and see what happens.</p>

<p><strong>Accessibility:</strong> Studies*<sup>6</sup> show that designs with a structured layout can improve comprehensibility for the user by up to 50%, making grid systems an effective factor for effective communication.</p></blockquote>

<h2 class="wp-block-heading">Challenges in Grid Design</h2>



<p class="wp-block-paragraph">Many designers find the creation and planning of responsive grids extremely tedious. In particular, calculating the necessary parameters is not so trivial, as all grid parameters are interrelated. See the following equations.</p>

<h3 class="wp-block-heading">There are three options for the even distribution of columns in CSS:</h3>



<ol class="wp-block-list">
<li><strong>‘space-between’ </strong>distributes the free space between the columns so that the first and last column are aligned directly to the edges of the grid.</li>



<li>With <strong>‘space-around’</strong> 50% of the free space is added to the right and left of each column.</li>



<li>With <strong>‘space-evenly’</strong> the free space is evenly distributed both between the columns and outside the columns.</li>

<h2 class="wp-block-heading">Design Basics</h2>



<p class="wp-block-paragraph">Many designers are also not familiar in detail with the design principles that later increase efficiency when placing elements and have a positive effect on the layout. It is therefore very important to understand the basics, i.e. the design laws themselves, in order to be able to work “creatively” with a grid system and not just follow best practice examples without reflection. For example, many designers unthinkingly create grid systems with 12 columns. Very few know the reasons for this, they simply follow certain standards without knowing when it can make sense to deviate from them.</p>



<p class="wp-block-paragraph">The reason for using a 12-column grid is that the number <strong>12</strong> is a so-called «<strong>Highly composite number</strong>»*<sup>7</sup>, i.e. a number that can be divided by more integers than any other smaller number. Apart from the fact that every number is divisible by 1 and itself, the <strong>12</strong> can be divided by 2, 3, 4, 6, whereas a <strong>10</strong> can only be divided by a 5. So a 12-column grid allows four times more flexibility in dividing the layout grid into different column combinations than a 10-column grid.</p>

		<title>The Ideal UX Design Workflow</title>

Changes in communication technologies have resulted in massive changes to the design workflow. Above all, they led to a different collaboration between designers and their clients.

<p>Whereas in the past, designers were often quite intuitive <strong>(weren’t they artists rather than engineers?)</strong> and were usually content-driven <strong>(form follows content)</strong>, modern design and communication theories have now established a user-centered and analytical approach.</p>
<p>In the past, as a designer, one liked to conjure the rabbit out of the cylinder like a magician, but nowadays, you take your clients in many small steps on the way to the final result, which is no longer a surprise for them, as it was worked out together in many workshops and meetings.</p>
<p>In the last twelve years, I have been able to try out different workflows in various positions and agencies. Again and again I was asked by project managers, supervisors and clients how the ideal design workflow looks and what the results of a visual concept are.</p>
<p>To be honest, there is no such thing as a perfect procedure. Every project and every budget requires its own, coordinated conceptual process.</p>
<p>Therefore, there are also a number of established procedures that have been applied correctly, all of which are certainly somehow successful, be it the <a href="https://en.wikipedia.org/wiki/Design_thinking" target="_blank" rel="noopener noreferrer">Design-Thinking methodology</a> or the <a href="http://www.jjg.net/elements/pdf/elements_ch02.pdf" target="_blank" rel="noopener noreferrer">5-layer-model</a> of Jesse James Garrett, which is not a workflow in itself, but rather a model of what a user-experience consists of.</p>

His model of the five layers of the user experience design forms the basis for this.</div></div></div>
			<p>Also very interesting is the <a href="https://medium.com/digital-experience-design/how-to-apply-a-design-thinking-hcd-ux-or-any-creative-process-from-scratch-b8786efbf812" target="_blank" rel="noopener noreferrer">Revamped Double Diamond workflow model</a> by Dan Nessler, which seems to me to be a bit too detailed and complicated, but was the godfather for one of my two following graphics.</p>
<p>What they all have in common is that each larger project should be divided into at least four to six phases, in which different methods are used to achieve very different results.</p>
<p>All of them follow a user-centered approach and agree to go into depth at each stage as far as possible, i.e., to work 100% focused on the previously defined goals of the relevant phase.</p>
<p>In the last few years, for both large and small UX projects, I have worked out my own optimal approach that gets the best out of all the models mentioned above. For this purpose, I have created two diagrams (one is directly following and the other is at the end of the article) that display my workflow from a different perspective.</p>

<p>My ‘DDIE model’ is based on the <strong>divergence-convergence model</strong> proposed by Béla H. Bánáthy in 1996 and adapted 2005 by the British Design Council. </p>
<p>It is characterised by its emphasis on the importance of first understanding problems fully (divergent thinking) and then arriving at targeted solutions (convergent thinking).</p>
<p>In the following text, I will deal specifically with these phases.</p></div>

			<h3>Here are the four phases of an optimal UX design development:</h3>
<h2>1. Discover (preparation and planning phase)</h2>
<p>A careful preparation and planning phase is important for every project. This is important because in this phase, some time and cost-sensitive posts are rammed into the ground, which is difficult to move. The briefing is very important.</p>

<p>In this stage, building on the design-thinking-methodology, I try to understand as much as possible all areas of my client, i.e., people, technology and the economy.</p>
<p>How does our client make his money, and what does he want from us? What characterizes his business model? What do its customers look like? What are his problems, challenges and opportunities?</p>
<p>In order to be able to advise our clients later on and offer them solutions to their problems, they must first lift us to their own level. This means he has to let us in on his business model, his successes and failures &#8211; the risks that might threaten him with failure. We need to know the DNA, the core of the business, its products or services &#8211; his vision, his passion.</p>
<p>Oftentimes, it makes sense to declare confidentiality at the beginning of the cooperation, so that both sides are aware that no trade secrets get into the wrong hands and a trustful cooperation is guaranteed.</p>
<p>Only by openly exchanging all relevant information and answering all the questions that arise can the UX designer put himself in a position to help his clients.</p>

			<h2>2. Define (concept phase)</h2>
<p>The aim of this phase is to define the tasks, challenges and questions for the creation phase &#8211; based on the knowledge about the users (= people), the product or system (= technology) and the framework conditions (= economy).</p>
<p>Therefore, research work and detailed user analysis are of central importance in this phase.</p>
<p>The next step is to understand the many individual pieces of information you have gathered and to summarize them into a meaningful and comprehensible guideline or communication concept. In design-thinking methodology, this is also known as <em>Point-of-View</em>.</p>
<p><strong>Task:</strong><br />

Expert review, cognitive walkthrough, user research, best-practice research, workshops</p>
<p><strong>Results:</strong><br />
Point-of-View or product/communication concept with detailed statements on target groups and user needs (via empathy maps or personas), on positioning (communication goals, distinctive features, benefit promise, tonality) and other important parameters (use cases, functional scope, content strategy&#8230;)</p>

			<h2>3. Ideate (creation phase)</h2>
<p>In this phase, you will first concentrate fully on generating ideas and solution proposals that you will then evaluate, further develop, combine or discard. Especially at the beginning of this phase, it is important not only to find a single &#8220;best&#8221; solution, but also to develop as broad a spectrum of ideas as possible, from which one can later select, or which, through a refinement or combination, can develop into something completely new, something that they would never have come up with on the spot.</p>
<p>Therefore, it is important to separate idea generation from idea evaluation. This gives free rein to your imagination and creativity, while soothing your rational brain half to come later.</p>

The entire creation phase represents an incremental or loop-like refinement of the questions and results. In the end, it supplies the raw material for the construction of prototypes and concrete solutions.

<p>There are many creative techniques that can be used in a useful way at this stage; listing them all here would go beyond that. However, a very important method is building or concrete visualization, i.e., prototyping itself can be an ideation technique. If you &#8220;produce&#8221; something, you quickly arrive at points where decisions have to be made, which in turn encourages the development of ideas based on it. A rough initial concept transforms quickly into a concrete solution.</p>
<p><strong>Task:</strong><br />
Development of ideas and solutions in the areas of&#8230;</p>
<p><strong>Information Architecture</strong><br />
• <strong>Methods:</strong> Content audit, workshops, card mapping and sorting<br />
• <strong>Results of work:</strong> structure diagrams, Excel tables,&#8230;</p>
<p><strong>Interaction Design</strong><br />
• <strong>Methods:</strong> Mind mapping, heuristic evaluation, creation of use cases or user journeys<br />
• <strong>Results of work:</strong> Scribbles, Flowcharts, Wireframes</p>
<p><strong>Visual Design</strong><br />
• <strong>Methods:</strong> Designing in Photoshop, Sketch and other tools<br />
• <strong>Results of work:</strong> Mood boards, mock-ups</p>

			<h2>4. Evaluate (test and optimization phase)</h2>
<p>The task of the test and optimization phase is to iteratively generate prototypes, which are used to answer questions that bring you closer to your final solution.</p>
<p>At the beginning of this phase, you should rather construct low-fi prototypes that are inexpensive and quick to build, but provide uncomplicated and useful feedback. First of all, the test persons can be their colleagues. The further you approach the final result, the more you should refine the prototype(s) and the questions.</p>
<p>A prototype can be anything that interacts with a user &#8211; whether it&#8217;s a wall of post-it notes or a click dummy of wireframes. It depends entirely on the questions that need to be answered. Would you like to test the names of a navigation or the self-explanatory ability of a complex user navigation?</p>
<blockquote><p>
Prototypes help to communicate. When a picture is worth a thousand words, a prototype says more than a thousand pictures.
</p></blockquote>
<p>Prototypes are especially valuable in customer communication. Frequently, stakeholders on the company side are overwhelmed by the increasing complexity of requirements and questions or cannot follow the complex project iterations. This can have serious consequences for the course of the project, as the decision-makers on the client side will then find it difficult to make the necessary decisions correctly and promptly.</p>

<p>Every mistake that is already discovered in the prototype, and not just before or after the Go-live, saves time and nerves.</p>

<h2>Double Diamond Process</h2>
<p>The two diamonds represent a four-stage process in which a complex task or problem to be solved is approached alternately in a divergent and convergent manner. In the middle, where the two diamonds almost touch, is a crucial moment in the process: the transition from problem identification to solution search. At this point, the problem is clearly defined and the way is paved for targeted creative solutions.</p>

		<title>From WCAG to WTF</title>

					<description><![CDATA[The unsexy side of design: Accessibility]]></description>

<p class="wp-block-paragraph">In the last years of my professional life, I have become more involved with accessibility than I was at the beginning of my career. Sometimes I wonder why. And I&#8217;ve talked to colleagues about what it&#8217;s like for them.</p>



<p class="wp-block-paragraph">In my research, I have also repeatedly tried to collect best practice examples of accessibility. I was struck by how few good examples there are. Even the solutions from organizations that deal with accessibility are often not really convincing. Why is that?<br></p>



<p class="wp-block-paragraph">One reason for this is certainly that most «Digital Designers» have not received adequate training in this area and have only rarely been made aware of this topic. In professional life, it is concrete client requests that lead designers to engage with this subject – very rarely do designers choose to dedicate themselves intensively to this topic on their own initiative. If they do, it is usually because they themselves have a disability or because there are people with disabilities in their environment, such as in their family or social circle. This results in 90 percent of my designer colleagues around me having only insufficient knowledge of accessibility. Most clients or digital agencies therefore have to turn to particularly specialized accessibility experts.</p>



<p class="wp-block-paragraph">But isn&#8217;t this a shame for our profession? Shouldn&#8217;t every UX designer have a solid understanding of accessibility?</p>



<p>&nbsp;</p>



<h2 class="wp-block-heading">We follow formal guidelines rather than asking people with disabilities</h2>



<p class="wp-block-paragraph">Yes, the majority of design-relevant WCAG guidelines are indeed known to my colleagues and are also applied. But is that enough? They believe that by using a contrast checker, employing sufficiently large fonts, and designing functional labels in such a way that they are recognizable regardless of their color, they have done enough from a design perspective to adequately consider accessibility.</p>



<p class="wp-block-paragraph">For me, the WCAG guidelines represent the minimum level of required measures. They were primarily developed with the aim of providing measurable and assessable quality criteria, not to offer «best practice recommendations» – which is a significant difference. I argue that a website that meets the WCAG AA conformance level is by no means a good website from the perspective of people with disabilities. Conversations with affected individuals have shown me this and explain why I find it so difficult to create a collection of best practices.</p>

<h2 class="wp-block-heading">When the accessibility guidelines themselves become a barrier</h2>



<p class="wp-block-paragraph">It also explains why the WCAG guidelines are so difficult to understand, because they are written from a legal perspective, which makes them extremely difficult to apply. I can think of hardly any set of regulations that has as many help and explanation websites as the WCAG guidelines.</p>



<p class="wp-block-paragraph">Instead of just asking each other what the minimum legal requirements are, we should ask ourselves what will help our users the most. As an accessibility-illiterate designer, I need more information than what is required by law. The «Denque Web Accessibility Checklist», for example, is helpful because it contains valuable best practice recommendations in addition to the WCAG guidelines &#8211; great!  </p>



<p class="wp-block-paragraph">Let&#8217;s imagine that when we design a website, we focus only on the legal requirements we have to comply with. Who would believe that this would result in good user-centred design?</p>



<p class="wp-block-paragraph">Beyond accessibility, every designer knows that conducting user interviews, focus group workshops and user testing is necessary to develop a truly effective solution.</p>



<p class="wp-block-paragraph">So I ask, how many of the sites that have achieved WCAG AA compliance have actually been tested with people with disabilities? How often have people with disabilities been consulted or invited to be part of the evaluation of the solutions during the conception phase? From my personal experience here in Switzerland, I would say that not even 5% of web solutions at WCAG AA compliance level have been approached in this way. Typically, they only rely on professional literature or experts who speak on behalf of people with disabilities. Is this really a user-centred approach in terms of equality?</p>

<h2 class="wp-block-heading">Taking a holistic user perspective </h2>



<p class="wp-block-paragraph">It would not only be fair, but also much more beneficial to consider all users in the design and not just the most frequent or average users, as is often done in UX research and testing.</p>



<p class="wp-block-paragraph">Imagining how someone is blind, or even better, how someone who is blind uses a smartphone, can be an insurmountable challenge for people who can see. People without disabilities often cannot imagine the challenges that people with disabilities face on a daily basis and which aids are really useful and which are superfluous.</p>



<p class="wp-block-paragraph">I often find that our clients want a ReadSpeaker or text-to-speech function on their website. This is because most accessible web solutions are planned or designed by people WITHOUT disabilities, WITHOUT consulting those concerned, otherwise they would know that visually impaired people no longer need this function (<a href="https://www.netz-barrierefrei.de/wordpress/hilfstechnik-und-mensch-maschine-interaktion/assistive-technologien-und-barrierefreiheit/brauche-ich-eine-vorlese-funktion-fuer-meine-webseite/" target="_blank" rel="noopener nofollow" title="">https://www.netz-barrierefrei.de</a>)</p>



<p class="wp-block-paragraph">It is therefore important that the designers and stakeholders involved in an accessibility project really «understand» what it means to be motor impaired, blind or deaf, and which aids are really useful and which are not. Otherwise, they cannot develop user-centered solutions that offer real added value for people with disabilities.</p>



<p class="wp-block-paragraph">In order to gain this empathetic understanding, contact and discussions with those affected, i.e. the actual core target groups of accessibility measures, are essential. Only in this way can the needs of users with disabilities be fully taken into account.</p>

It is not suitable for a comprehensive representation of disabilities, it appears passive, negative and not inviting or inclusive.</figcaption></figure>

<h2 class="wp-block-heading">More Show Than Substance</h2>



<p class="wp-block-paragraph">I frequently encounter clients who come to us wanting to make an existing website «accessible» ???</p>



<p class="wp-block-paragraph">This alone indicates that something went wrong in the preceding conception phase. It also shows that formal compliance with accessibility guidelines (for example, through certification) is valued more highly than actually aligning with the needs of people with disabilities. Those who have spoken with the affected individuals know how far this type of accessibility misses the mark.</p>



<p class="wp-block-paragraph">Ask yourselves: What percentage of your personas in the last UX project were people with disabilities? Or what percentage of your test participants in the last usability test? According to the Federal Statistical Office, in Switzerland, 22 percent of the population is disabled in the sense of the Equality Act, meaning they have a disability that significantly impairs their participation in social life. Have you proportionally considered this percentage in your surveys and tests?</p>

<h2 class="wp-block-heading">Inclusion in the conception process instead of subsequent accessibility checks</h2>



<p class="wp-block-paragraph">Why not prioritize accessibility in the next project planning, starting with the first meeting with the client? Often, accessibility considerations are only addressed towards the end of the conception phase, when many design parameters have already been set. Do you believe this adequately accounts for the interests of people with disabilities?</p>



<p class="wp-block-paragraph">I would also appreciate it if particularly well-designed accessible websites were recognized with an award – and preferably by people with disabilities. This would definitely help me in my search for best practice examples and make it easier for many others to follow good examples.</p>



<p class="wp-block-paragraph">And let me ask the group? Why is there no «<strong>Accessibility</strong>» category in the <strong>«<a href="https://www.bestofswissweb.swiss/" target="_blank" rel="noopener nofollow" title="">Best of Swiss Web Award</a>»</strong>? Huh?</p>

<h2 class="wp-block-heading">A brief history of equality for people with disabilities</h2>



<p class="wp-block-paragraph">Attitudes towards people with disabilities have changed considerably over the course of human history and in different cultures. In many societies of the past, people with disabilities were stigmatised and marginalised. In antiquity and the Middle Ages, disability was often seen as a punishment from God or a sign of possession.</p>



<p class="wp-block-paragraph">With the Enlightenment and growing social awareness of human rights, society began to take a closer look at the problems of people with disabilities. The first charities and institutions for people with disabilities began to emerge, although often with the aim of segregation rather than integration.</p>



<p class="wp-block-paragraph">After the devastating effects of the world wars, public awareness of the situation of people with disabilities increased. In parallel with the civil rights and women&#8217;s rights movements of the 1960s in the US and Europe, disability rights movements also emerged, campaigning for equal rights for people with disabilities and the removal of barriers. These movements laid the foundations for modern equality legislation and inclusion policies.</p>



<h3 class="wp-block-heading">Major milestones on the road to equality for people with disabilities:</h3>



<ul class="wp-block-list">
<li><strong>1973:</strong> Passage of the Rehabilitation Act in the US, prohibiting discrimination on the basis of disability in federal programmes.</li>



<li><strong>1990:</strong> Introduction of the Americans with Disabilities Act (ADA) in the US, a comprehensive anti-discrimination law.</li>



<li><strong>2006:</strong> The United Nations adopts the UN Convention on the Rights of Persons with Disabilities (UN CRPD), which comes into force in 2008 and strengthens the rights of people with disabilities worldwide.</li>
</ul>



<p class="wp-block-paragraph">Gradually, many countries have adopted laws and policies that protect and promote the rights of people with disabilities. The UN Convention on the Rights of Persons with Disabilities has been legally ratified by more than 180 countries. However, there is still social stigma and a lack of awareness of the needs of people with disabilities in many areas.</p>

<h2 class="wp-block-heading">Participation in digital life</h2>



<p class="wp-block-paragraph">With the advent of digital transformation, the scope of gender equality efforts has broadened considerably. Digitalisation affects almost every aspect of our daily lives &#8211; from the way we communicate and share information, to education, work and social interaction. For people with disabilities, this opens up new opportunities for participation, but also creates new barriers.</p>



<p class="wp-block-paragraph">The transition to digital equality requires a rethink of our society. It is about using technological innovation to break down barriers. Technologies such as visual aids, screen readers, voice control or personalised user interfaces can play a crucial role. This shift offers the opportunity to take equality for people with disabilities to a new level. Companies that actively embrace this change can benefit from an expanded customer base and a positive public perception.</p>



<p class="wp-block-paragraph">History shows that progress in equality for people with disabilities has only been achieved through legislation. Most companies are not proactive in the area of accessibility, for many reasons that I won&#8217;t go into now, but it shows us how crucial political decisions and legal regulations are for progress in accessibility.</p>

<p class="wp-block-paragraph">Digital accessibility, which aims to enable people with disabilities to participate fully in society, is defined internationally by the W3C&#8217;s WCAG guidelines. The first version of these guidelines was published in 1999 and has since become the basis for many national digital accessibility laws.</p>



<p class="wp-block-paragraph">EU standards and guidelines are also based on the WCAG specifications. These are transposed into national law by the member states independently. Germany, for example, implements the EU directives through the Disability Equality Act (BGG) and the Barrier-free Information Technology Ordinance (BITV 2.0). In Switzerland, accessibility is regulated by the Disability Equality Act (BehiG) and the associated Disability Equality Ordinance (BehiV).</p>



<p class="wp-block-paragraph">However, the WCAG and the legislation derived from it have been criticised for not taking sufficient account of cognitive disabilities. There are certainly historical reasons for this gap. It stems primarily from a working world in which work was still predominantly physical, which has already led to some improvements for people with physical disabilities. For people with cognitive disabilities, however, there is still a great need for support.</p>



<p>&nbsp;</p>



<h2 class="wp-block-heading">Situation in Switzerland in 2024</h2>



<p class="wp-block-paragraph">After a thorough review in March 2002, the «UN Committee on the Rights of Persons with Disabilities» came to a sobering conclusion: Switzerland violates the rights of persons with disabilities in many areas, and the inclusion required by the Convention is still not sufficiently practised at all levels of government and society. There is still a great need for action in Switzerland with regard to all the equality directives listed.</p>



<p class="wp-block-paragraph">For example, most adults with cognitive impairment in Switzerland are not free to choose where and how they live. Children with cognitive impairments often attend special schools. And information about elections and voting is often too complicated for many people with cognitive impairments. <p class="wp-block-paragraph">In addition, most guidelines in Switzerland are not binding, but only recommendations. As a result, implementation is slow and hesitant.</p>

<h2 class="wp-block-heading">Groups of people who benefit from accessible services</h2>

<p class="wp-block-paragraph">About 35% of the Swiss population depend on accessible services in many areas. The rest of the population also generally benefits from improved accessibility and usability.</p>



<p>&nbsp;</p>



<h2 class="wp-block-heading">Accessibility offers only advantages, not disadvantages</h2>



<p class="wp-block-paragraph">The number of people who benefit from accessibility is much higher than most people would expect. In Switzerland, around 22% of the population is considered disabled under the Equality Act, but in reality many more people benefit from accessibility.</p>



<p class="wp-block-paragraph">Accessibility affects not only people with disabilities, but also older people, migrants with insufficient language skills or functional illiterates. Including these groups, at least 35% of the population directly benefits from accessibility measures. But everyone else also benefits from accessible solutions in special situations such as poor lighting or noisy environments.</p>



<p class="wp-block-paragraph">Businesses should not wait for legislation to force them to be accessible, but should see it as an opportunity to expand their target groups and customer base. Accessibility improves the user experience for everyone and creates competitive advantage.</p>



<p class="wp-block-paragraph">As mentioned above, some improvements for people with physical disabilities have already been achieved through the implementation of existing directives. Many public sector websites are already optimised for people with visual and hearing impairments, but access to digital life is often still inadequate for people with cognitive impairments. For example, very few websites offer content in &#8220;easy or plain language&#8221; &#8211; and when they do, it is mainly on the pages of organisations dedicated to this topic. Cultural or commercial offerings, such as online shops, that cater to the needs of people with cognitive impairments are rare. However, there are already tried and tested concepts that could make it easier for many people to access information (see also my <a href="https://thomas-sokolowski.com/en/wp-admin/post.php?post=1365&amp;action=edit" target="_blank" rel="noopener" title="">blog post «<strong>Easy-to-read and plain-language design</strong>»</a>).</p>



<p class="wp-block-paragraph">From June 2025, the &#8216;<strong><a href="https://www.osborneclarke.com/insights/eu-accessibility-act-time-start-implementation-projects-now" target="_blank" rel="noopener nofollow" title="">European Accessibility Act</a></strong>&#8216; will also require private companies in the EU to ensure accessibility. Companies that fail to make their digital services accessible will face fines and even closure. This will affect more than 3 million website and mobile app providers in Germany alone, as well as many companies in Switzerland that offer their products and services in the EU.</p>



<p class="wp-block-paragraph">I expect that these legal requirements will bring movement to the hitherto hesitant implementation of accessibility guidelines.</p>



<p class="wp-block-paragraph">So designers and developers of digital services have a lot of work ahead of them.</p>

<h2 class="wp-block-heading">Appendix</h2>



<h3 class="wp-block-heading">The extent of disability worldwide:</h3>



<p class="wp-block-paragraph">The following estimates are based on global data from the World Health Organisation (WHO) and other international organisations.</p>



<ol class="wp-block-list">
<li><strong>Visually impaired and blind:</strong> Approximately 1.2 billion people worldwide (about 15% of the world&#8217;s population) live with a visual impairment or blindness that cannot be fully corrected by visual aids.</li>



<li><strong>Hearing impaired and deaf:</strong> More than 1.5 billion people worldwide are living with a hearing impairment. Of these, about 430 million people (about 5% of the world&#8217;s population) have a hearing impairment that is considered &#8216;severe&#8217;.</li>



<li><strong>Motor disabilities: </strong>About 2% of the world&#8217;s population has a severe mobility impairment. These people are permanently dependent on walking aids or wheelchairs. Mild and moderate motor disabilities are much more common. It is estimated that between 15% and 20% of the world&#8217;s population has a physical mobility impairment and has difficulty walking long distances, climbing stairs or using vehicles or public transport.</li>



<li><strong>Cognitively and psychologically disabled people:</strong> According to WHO estimates, 15 to 20% of the world&#8217;s population is affected by cognitive or psychological impairments. Cognitive disabilities (intellectual impairments) affect around 1 to 3% and psychological disorders around 15% of the world&#8217;s population. Studies show that around 20 &#8211; 25% of people with psychological disorders have difficulties using the internet or other social resources, especially during periods of acute illness or without sufficient support.</li>



<li><strong>Illiterate people and people with significant reading and writing difficulties:</strong> About 14% of the world&#8217;s adult population is illiterate. In addition, about 25% are functionally illiterate, able to read or write only a few sentences.</li>



<li><strong>Migrants with poor language skills:</strong> According to the International Organisation for Migration (IOM), about 281 million people will be migrants in 2020, representing about 3.6% of the world&#8217;s population. Assuming that around 35% of the world&#8217;s migrants have language integration difficulties, this would affect around 1.5% of the world&#8217;s population.</li>



<li><strong>The socio-economically excluded people:</strong> This group is highly dependent on regional and socio-economic conditions, so their numbers vary considerably depending on where they live.
<ul class="wp-block-list">
<li><strong>People living in extreme poverty: </strong>It is estimated that around 10% of the world&#8217;s population live in extreme poverty (defined by the World Bank as living on less than USD 1.90 per day).</li>



<li><strong>Social exclusion: </strong>War, political and religious conflicts lead to the social exclusion of people around the world. It is estimated that about 32% of the world&#8217;s population (about 2.4 billion people) experience significant social restrictions and have very limited access to education, information and social participation.</li>
</ul>

<h3 class="wp-block-heading">Notes:</h3>



<ul class="wp-block-list">
<li><strong>Temporary disabilities:</strong> Short-term disabilities due to illness or accident increase the number of people affected. Almost everyone is affected by one or more of these disabilities for at least part of their lives &#8211; due to illness, accident or age.</li>



<li><strong>People without disabilities: </strong>Taking into account overlapping and temporary disabilities, the proportion of people with no disability may be less than 50% of the world&#8217;s population. In particular, extreme poverty, functional illiteracy and mild disabilities such as visual and mobility impairments affect a large number of people.</li>



<li><strong>Age-related disabilities: </strong>As the average age of the world&#8217;s population rises, the number of people with disabilities will continue to increase because the proportion of people with disabilities increases with age. To illustrate: In Switzerland, only about 10% of young adults between the ages of 16 and 24 have a disability as defined by the Equal Opportunities Act, while the figure is around 40% for people over the age of 85.</li>

<p class="wp-block-paragraph">In today&#8217;s world, reading is essential for participation in social life. Yet billions of people struggle with reading – not only in developing and emerging countries, but also in wealthy industrialized nations.</p>



<p class="wp-block-paragraph">These difficulties often stem not only from a lack of education or cognitive impairments, but also from unnecessarily complex language.</p>



<p class="wp-block-paragraph">Either way, information providers would be well advised to consider whether their target audiences actually understand the content they are providing, and whether it should be simplified.</p>



<p>And designers in particular should ask themselves how to design for cognitively impaired users.  There is not much literature or accepted design guidelines about it.</p>

<p>&nbsp;</p>



<p class="wp-block-paragraph"><strong>There are two linguistic concepts to make texts easier to understand:</strong></p>



<h2 class="wp-block-heading">1. Easy Read or Easy-to-Read Language</h2>



<p class="wp-block-paragraph">«Easy Read» is a simplified form of language specifically designed to make texts easier to understand. It is designed not only for people with cognitive impairments, but also for those with language barriers or lower levels of education.</p>



<h2 class="wp-block-heading">2. Plain Language</h2>



<p class="wp-block-paragraph">«Plain Language» is also a simplified form of language. However, compared to Easy Read, it is less simplified and intended for a broader audience. This allows for more detailed descriptions of topics.</p>



<p class="wp-block-paragraph">There is no sharp distinction between Easy Read and Plain Language; the transitions between them are fluid. The focus is on the target audience: Easy Read is primarily intended for people with cognitive impairments, while Plain Language is primarily intended for people learning a language as a second language or for people with limited reading skills.</p>

<h2 class="wp-block-heading">What is the structure of Easy Read or Plain Language texts?</h2>



<p class="wp-block-paragraph">Texts in Easy-to-Read or Plain Language should contain only short sentences. Especially in Easy-to-Read Language, each sentence should contain only one statement. Complex structures such as double negatives, passive voice or subjunctive should be avoided. <h2 class="wp-block-heading">Comprehension problems are omnipresent </h2>



<p class="wp-block-paragraph">As numerous studies have shown, our reading skills are steadily declining. Due to the strong influence of our modern communication technologies and the intensive use of social media, many young people have only a B2 level in their native language. In our example, this corresponds to the text in the «Simple Language» tab.</p>



<p class="wp-block-paragraph">Our example text in the «Complex Language» tab is perceived as too challenging by most under 20-year-olds and is therefore not read. This text leads to a complete breakdown in communication with this target group.</p>



<p class="wp-block-paragraph">Any company or information provider wishing to address younger target groups should take this into account and, if necessary, offer their content in Plain Language only in the future. Otherwise, they run the risk of being ignored by this target group.</p>

<h2 class="wp-block-heading">Designing for Easy-to-Read Language</h2>



<p class="wp-block-paragraph">One area that still receives little attention is the design of Easy-to-Read Language content. Most of the information available on Easy-to-Read and Plain Language refers only to translation or writing of text, but not to design principles or an overarching information architecture. The question of how to optimally design the user interface of a website in Easy-to-Read Language has so far only been answered to a limited extent.</p>



<p class="wp-block-paragraph">Although the general rules of accessibility and good readability provide a solid foundation, they are not sufficient to adequately consider audience-oriented information architecture or perceptual psychological factors. But for a comprehensive and effective design of media products, these aspects are crucial.</p>



<p class="wp-block-paragraph">Although a draft of the DIN standard 33429 «Easy-to-Read Language» was published in 2023, it does also not provide any guidance on the influencing factors of style and information architecture.</p>



<p class="wp-block-paragraph">In the end, I had to work out many of the principles myself. In particular, the user tests I conducted brought many design guidelines to light. The most important guidelines are listed below.</p>

<h2 class="wp-block-heading">Design principles for websites in Easy Read or Plain Language</h2>



<h4 class="wp-block-heading">In general</h4>



<ul class="wp-block-list">
<li>Use all accessible design standards that meet AA requirements.</li>



<li>The basic rules of typography for good readability apply especially to Plain Language content.</li>



<li>People with reading disabilities are more sensitive to usability issues. For this reason, it is especially important that all elements are self-explanatory and can be used as expected.</li>



<li>Even if it is stimulating and creative for a designer to break with traditional and established design concepts, this should be avoided in the area of Easy Read, as deviations from familiar patterns lead to high cognitive stress for the target group.</li>
</ul>



<h4 class="wp-block-heading">Layout</h4>



<ul class="wp-block-list">
<li>Follow the rules of «mobile-first design» as much as possible, i.e., implement a single-column layout with as few responsive breaks as possible.</li>



<li>If this is not possible, make sure there is enough space between horizontal sections and, if necessary, frame them or otherwise mark them as a group unit.</li>



<li>Use only left-aligned text constructions</li>



<li>Although it can be stimulating and creative to break through established, expected concepts, it is advisable to avoid this in the area of Easy-to-Read language, as deviations from familiar patterns can lead to high cognitive load.</li>
</ul>



<h4 class="wp-block-heading">Information Architecture</h4>



<ul class="wp-block-list">
<li>First things first: Build your structure logically and list the most important information first, not at the end.</li>



<li>Organize information into sections that are clear and easy to understand. Limit the number of sections to no more than five or six on a content page.</li>



<li>Add plenty of white space between sections and use clear headings to make the page easier to skim and scan. The space before a heading should be at least three times the font size.</li>



<li>Groups or lists, such as the navigation, should have no more than five to six items.</li>



<li>Avoid multiple levels of information, such as subcategories.</li>



<li>Units that belong together (all items in a group) can be grouped well with a clear border or light background color.</li>



<li>Expandable lists or accordions are well understood by Easy-to-Read target groups. These should be clearly marked as clickable.</li>
</ul>



<h4 class="wp-block-heading">Typefaces</h4>



<ul class="wp-block-list">
<li>For body text, use a simple, unornamented font that is easy to read. Serif fonts such as «Times New Roman» can be used also for this purpose.</li>



<li>A different font (e.g. a sans-serif headline font for a basic serif font) or a different color can be used for headlines.</li>



<li>It is generally recommended to set all headlines to bold or semi-bold to clearly identify them as such.</li>



<li>Use font styles (combinations of size, color, typeface, and style) consistently and functionally within a media product, and limit them to a maximum of six styles.</li>



<li>Use a minimum font size of 22px for body text. Depending on the typeface family or use case, this may be larger.</li>



<li>Do not use too many font sizes &#8211; a maximum of three to four and clearly distinguishable gradations, such as 24, 48 and 72px.</li>
</ul>



<h4 class="wp-block-heading">Typographic rules</h4>



<ul class="wp-block-list">
<li>Avoid italic or bold emphasis within a paragraph of text.</li>



<li>Always avoid shading fonts.</li>



<li>If possible, underlining should not touch or cross out the descenders of letters.</li>



<li>Use only mixed upper and lower case.</li>



<li>Line spacing in body text should be at least 160% of the font size.</li>



<li>Use one line per sentence. Column width and font size should be chosen so that there are no line breaks within a sentence, even on small devices such as smartphones.</li>
</ul>



<h4 class="wp-block-heading">Lists and tables</h4>



<ul class="wp-block-list">
<li>Use lists rather than commas to break up blocks of text, especially when describing procedures or instructions.</li>



<li>Use large list characters before lines of text.</li>



<li>Use ordinal numbers only when you want to make a sequence clear.</li>



<li>Use tables to make complex material easier to understand. A table should have no more than 4-5 columns and no more than 5-6 rows.</li>
</ul>



<h4 class="wp-block-heading">Tonality</h4>



<ul class="wp-block-list">
<li>Using a childish or naive style could give the impression that the target audience is being infantilized, which in turn could affect their self-image and dignity. It is therefore important to choose the visual style carefully to ensure respect and professionalism.</li>



<li>The key to the appropriate visual style lies in a primarily functional and expectation-compliant style. All visual elements should be clearly understood by the target audience, regardless of style. A minimalist or modern style can work just as well, as long as it has the necessary clarity and comprehensibility.</li>

<p class="wp-block-paragraph"><strong><mark style="background-color:rgba(0, 0, 0, 0)" class="has-inline-color has-luminous-vivid-orange-color">ChatGPT&#8217;s answers summarized: </mark></strong>AI systems are designed for consensus and averageness, not «innovation». </p>

<p class="wp-block-paragraph"><em>Here is my complete, in my opinion very interesting dialog with ChatGPT:</em></p>



<p class="wp-block-paragraph"><strong>Thomas:</strong> Hi ChatGPT, I have a few questions about your way of thinking and working. When I ask you a question, your neural network is programmed to provide me with the &#8220;most probable response&#8221;, is that correct?</p>



<p class="wp-block-paragraph"><strong><mark style="background-color:rgba(0, 0, 0, 0)" class="has-inline-color has-luminous-vivid-orange-color">ChatGPT:</mark> </strong>Yes, you could summarize it like that. Everything I do is based on patterns and statistical probabilities.</p>



<p class="wp-block-paragraph"><strong>Thomas: </strong>So you can&#8217;t really think. You also don&#8217;t know what you know, you&#8217;re more like a trained dog that knows what to do when its master gives it a certain command.</p>



<p class="wp-block-paragraph"><strong><mark style="background-color:rgba(0, 0, 0, 0)" class="has-inline-color has-luminous-vivid-orange-color">ChatGPT:</mark></strong> That&#8217;s an accurate analogy. My functioning is actually more like a well-trained dog than a thinking being. Here are some points to illustrate that: I have no consciousness and don&#8217;t really know what I &#8220;know&#8221;. Much like a trained dog that responds to certain commands, I respond to your input based on the probabilities and patterns I&#8217;ve seen in the training data.</p>



<p class="wp-block-paragraph"><strong>Thomas: </strong>All right, since you don&#8217;t know what you know, of course you don&#8217;t know what you don&#8217;t know either, do you? If I ask you what doesn&#8217;t yet exist in an area, then your answer is generated in the form that would be the &#8220;semantically&#8221; correct answer to that question. You&#8217;ve only learned a preconceived answer to that question, but it&#8217;s not based on any actual research or verification. Is that correct?</p>



<p class="wp-block-paragraph"><strong><mark style="background-color:rgba(0, 0, 0, 0)" class="has-inline-color has-luminous-vivid-orange-color">ChatGPT: </mark></strong>Yes, something like that. For one thing, I don&#8217;t work on the basis of rules. For another, I don&#8217;t use pre-formulated answers. My answers are based on the weights and tokens defined during the training phase to select the most appropriate semantic tokens for my answer. Furthermore, from my version 4 onwards, I can also search for information on the internet, but this additional information is only added within the prompt as contextual information to my model parameters, just like the information you provide in our dialog. So this information can actually, at least in our dialog, close knowledge gaps, but it does not change my basic model parameters. This would be theoretically possible, but is not intended, as users could fundamentally manipulate or change me in this way.</p>



<p class="wp-block-paragraph">But yes, as you prefaced your question, I have no understanding of my own knowledge or gaps in it. I also have no direct access to my knowledge, as it is not in the form of a conventional database that could be searched via search algorithms, but in the form of neural model parameters that neither I nor my developers can consciously access. In other words, neither I nor my developers know in detail how I arrive at my outputs. I know that this is difficult to understand, but it is one of the fundamental properties of a multilayer neural network that stores knowledge about model parameters.</p>



<p class="wp-block-paragraph"><strong>Thomas: </strong>OK, but do I understand you correctly that the contents of your texts and pictures correspond to what is known consensus, because you were designed to analyze your training data for similarities, but not for &#8220;dissent, &#8220;missing aspects&#8221;, &#8220;errors&#8221; or &#8220;contradictions&#8221;. You&#8217;re not looking for gaps or missing aspects in either the training or application phase, just existing ones, right?</p>



<p class="wp-block-paragraph"><strong><mark style="background-color:rgba(0, 0, 0, 0)" class="has-inline-color has-luminous-vivid-orange-color">ChatGPT: </mark></strong>Yes, that is correct. My answers tend to reflect the consensus because I have been built to search the data provided to me for general patterns and consensus. This leads me to provide answers that match the most commonly held views and information.</p>



<p class="wp-block-paragraph"><strong>Thomas: </strong>Are you aware that some innovations are based precisely on finding something outside the norm?</p>



<p class="wp-block-paragraph"><strong><mark style="background-color:rgba(0, 0, 0, 0)" class="has-inline-color has-luminous-vivid-orange-color">ChatGPT: </mark></strong>Yes, I am aware of that. Many innovations and creative breakthroughs result from the ability to think outside the norm and to recognize disconsensus or missing aspects. I completely lack this ability.</p>



<p class="wp-block-paragraph"><strong>Thomas: </strong>So you are only creative in the sense that you resample existing patterns according to principles or procedures that you know, but not by developing or adding ideas that are unknown or new to you. Nor can you transform in the actual sense, since you cannot think at all and therefore cannot &#8220;negate&#8221; or &#8220;transform&#8221; because you lack any sense of logic, can you?</p>



<p class="wp-block-paragraph"><strong><mark style="background-color:rgba(0, 0, 0, 0)" class="has-inline-color has-luminous-vivid-orange-color">ChatGPT: </mark></strong>Yes, that is correct. My creativity is limited to re-sampling and combining existing patterns and information. I can&#8217;t generate new or original ideas outside of those patterns, nor can I consciously negate or think in any form because I lack the skills of self-reflection and conscious thought.</p>



<p class="wp-block-paragraph"><strong>Thomas: </strong>Is this the reason why many designs generated by AIs are rather average and not really exciting or innovative?</p>



<p class="wp-block-paragraph"><strong><mark style="background-color:rgba(0, 0, 0, 0)" class="has-inline-color has-luminous-vivid-orange-color">ChatGPT: </mark></strong>Yes, AI models like me are trained to reflect the consensus or the average. The learning methods used (LTSM, Transformer, etc.) lead to a strong weighting of frequently occurring content. How should I know what is potentially innovative? It is more likely that potentially innovative content is weighted less by my learning algorithms due to its rarity and is therefore not learned by me.</p>



<p class="wp-block-paragraph"><strong>Thomas: </strong>Okay, now I realize a lot. But what does the future hold? Is that in the fundamental nature of AI or is it conceivable or even likely to develop AI systems that have capabilities such as negation, reasoning and creative innovation?</p>

<li><strong><mark style="background-color:rgba(0, 0, 0, 0)" class="has-inline-color has-luminous-vivid-orange-color">Self-reflection and metacognition: </mark></strong>AI models may one day be developed that recognize their own knowledge gaps and actively search for new information to fill them.</li>



<li><strong><mark style="background-color:rgba(0, 0, 0, 0)" class="has-inline-color has-luminous-vivid-orange-color">Hybrid models: </mark></strong>combinations of symbolic AI approaches (which support logical thinking) and neural networks could be developed to leverage the strengths of both approaches.</li>

<p class="wp-block-paragraph">Regrettably, today&#8217;s AI systems are still a long way from these approaches. There are AI systems that are capable of &#8220;rule-based&#8221; thinking. These systems use explicitly coded rules to draw logical conclusions and make decisions. However, the rigid rule structures prevent &#8220;learning&#8221;.</p>



<p class="wp-block-paragraph">Far more advanced approaches are needed to develop truly creative systems. The solution could lie in combining different methods that combine rule-based thinking, machine learning and other AI technologies. It remains to be seen what the future holds in this direction.<br><br>Thomas: Thank you for the interview.</p>
